1. INTERPRETATION & VARIATION

  1. In these Terms and Conditions the following definitions apply:
    • Client” means a Member, Patient or User.
    • Company” means &Osteo Fitness Ltd and/or &Osteo Therapies Ltd, as appropriate, both located at 179 Brockley Road, London, SE4 2RS.
    • Company Personnel” means any director, employee, contractor or similar working with or for the Company.
    • Member” means any person who has completed and submitted the Registration Form to access the Studios and any facilities or parts of the Premises related thereto which registration has been accepted by the Company.
    • Patient” means any person who has completed and submitted the Registration Form to access the Treatment Rooms and any facilities or parts of the Premises related thereto which registration has been accepted by the Company.
    • Premises” means the Studio, Treatment Rooms and all other parts of 179 Brockley Road, London, SE4 2RS.
    • Registration Form” means the online registration form accessed via the Website.
    • Sessions” means any class or similar to be conducted using a Studio.
    • Studios” means the studios (or either one of them) and any facilities or parts of the Premises related thereto at 179 Brockley Road, London, SE4 2RS.
    • Treatment Rooms” means the therapy rooms (or any one of them) and any facilities or parts of the Premises related thereto at 179 Brockley Road, London, SE4 2RS.
    • User” anyone using the Company’s website.
    • Terms and Conditions” means these Terms and Conditions.
    • Website” means www.andosteo.co.uk and any sub-domains of this Website unless expressly excluded by their own terms and conditions.
  2. References in the Terms and Conditions to the singular include the plural and vice versa and references to the masculine gender include references to the feminine gender and vice versa (unless, in each case, the context otherwise requires).
  3. These Terms and Conditions together with the Company’s Privacy Policy shall constitute the entire agreement between the Company and the Client in relation to the use of the Website and the Premises (including particularly the Studios and Treatment Rooms).
  4. If a provision of these Terms and Conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect.
  5. The Company reserves the right to vary and revoke the Terms and Conditions from time to time which variation it may consider necessary or desirable for the regulation of the affairs of the Studio, the Treatment Rooms and the conduct of Clients. Any such changes will be notified by a change to these Terms and Conditions on the Website and, until revoked, are and will be binding on Clients.
  6. The Terms and Conditions will be governed by the laws of England and subject to the exclusive jurisdiction of the English courts.

GENERAL: USE OF STUDIO AND TREATMENT ROOMS

2. MEMBERSHIP

  1. To become a Member or Patient and access the Premises the Registration Form must be completed and submitted by the individual wishing to become a Member or Patient and accepted by the Company.
  2. By completing and submitting the Registration Form the User agrees to these Terms and Conditions.
  3. Acceptance of a person as a Member or Patient is in the absolute discretion of the Company.
  4. The Company reserves the right to expel from the Premises, or suspend for a specific period or refuse to renew the membership of any Member or Patient whose conduct is or may, in the Company’s opinion, be injurious to the character of the Premises or which amounts to a breach of the Terms and Conditions or where such expulsion is otherwise in the interests of the Company Personnel or other Clients. Any person so expelled will forthwith cease to be a Member or Patient as relevant.
  5. Members must be a minimum of 18 years of age. Individuals aged 16 and 17 are permitted to become Members subject to express written consent from a parent or guardian.  Individuals aged under 16 are permitted, at the discretion of the Company and the class instructor for the relevant Session, to join a Session as a Member for that Session only if accompanied by their parent or guardian.
  6. Patients must be a minimum of 16 years of age. Individuals aged under 16 is permitted to become a Patient if accompanied to the Treatment Rooms by their parent or guardian.

3. STUDIO OPENING TIMES

Details of session times at the Studio may vary from time to time.  Session times will be published by the Studio and will be available at www.andosteo.co.uk.

4. PAYMENT TERMS

  1. Details of Session and treatment prices and gift certificate prices are available at andosteo.co.uk or directly from the Studios or Treatment Rooms and will be determined by the Company.
  2. A Member may not attend any Session at the the Studio without booking and paying in advance for the relevant Session.
  3. A Patient may not attend the Treatment Rooms without booking and paying in advance for the relevant treatment.
  4. Payments for Sessions, treatments and gift certificates are non-refundable unless otherwise stated in the Terms and Conditions.

5. BOOKINGS & CANCELLATIONS

  1. A Member or Patient may only book or reschedule Sessions or treatments for themselves and only via the booking facility accessed from andosteo.co.uk.
  2. Members will be charged for a booked Session where the cancellation or rescheduling is not made online (or notice of the same is not delivered by hand to the Studio, received in person and processed by Company Personnel) at least:
  3. 6 hours prior to the advertised start time for the booked group Session; or
  4. 24 hours prior to the pre-arranged start time for Personal Training bookings.
  5. Studio sessions are booked on a first-come first-served basis. A Member may use the waitlist facility at andosteo.co.uk in the event that their first choice session is unavailable.
  6. Patients will be charged for a booked treatment where the cancellation or rescheduling is not made online (or notice of the same is not delivered by hand to the Treatment Rooms, received in person and processed by Company Personnel) at least 24 hours prior to the pre-arranged start time for the treatment.

6. FITNESS & HEALTH

  1. By agreeing to these Terms and Conditions Members confirm they have no known underlying health conditions which are contra indicated for the Sessions they wish to participate in and are physically capable to participate.
  2. It is the Member’s responsibility to notify the Studio and specific Company Personnel acting as class instructor of any circumstances affecting their health which may be exacerbated through use of the Studio and/or have arisen or worsened since their last Session.
  3. Members are advised not to undertake strenuous physical activity without first seeking medical advice if they have concerns over their physical condition or wellbeing.
  4. The Company reserves the right to refuse access to the Premises and any Session to any Member if, in its discretion, it considers that the health of the individual or any other Client or Company Personnel may be endangered by the Member’s presence at the Premises or undertaking a Session.
  5. Members are required to follow the instructions of the class instructor and Company Personnel at all times.
  6. Members shall not be allowed to attend any Session whist under the influence of alcohol or drugs. In the event a Member attends while under the influence of alcohol or drugs they do so entirely at their own risk.
  7. Members are not allowed to use any of the Studio’s equipment unsupervised or outside the Sessions.
  8. Members who suffer an accident or injury on the Premises must report the accident or injury and the circumstances immediately following the incident to one of the Company Personnel.

7. LIMITATION OF LIABILITY

  1. The Company cannot be held responsible for any particular Session, Company Personnel acting as class instructor and/or item of equipment not being available for whatever reason. The Company reserves the right to make alterations to the Sessions, class instructors and/or equipment, as well as to the facilities provided to Members, without notice and will not be liable for any loss occasioned by such alterations.
  2. It is the Member’s responsibility to ensure that they are capable of undergoing a routine of exercises provided by any programme followed, class or Session undertaken. Members accept the risk of injury from performing exercises and using equipment and are advised to consult their doctor prior to beginning any Session.  Advice provided by Company Personnel (including class instructors) does not constitute medical advice and is not a substitute for advice provided by a medical professional.
  3. The Company accepts no liability for loss or damage to property of Members or Patients or for injury to Members or Patients on the Premises or outside the Premises except insofar as such loss, damage or injury is by law incapable of exclusion.
  4. In consideration of their participation in the activities and programmes offered by the Company and the use of facilities and equipment owned and/or under the control of the Company the Member hereby waives and releases the Company from any and all responsibility or liability for injuries or damages resulting from their presence on the Premises and/or participation in any of the Company’s Sessions or activities and/or use of the equipment or facilities save in respect of death or personal injury caused by the negligent act or omission of the Company.
  5. Each Patient hereby waives and releases the Company from any and all responsibility or liability for injuries or damages resulting from their presence on the Premises and/or participation in any of the Company’s activities and/or use of the equipment or facilities save in respect of death or personal injury caused by the negligent act or omission of the Company.
  6. COVID-19 Assumption of risk. Clients accept that despite the Company is taking and implementing precautions in accordance with Government guidance related to COVID-19.  The Company cannot guarantee that you Clients will not be exposed to COVID-19, including without limitation through touching and using equipment, Studio and/or Treatment Room facilities, and/or amenities, participating in Sessions, and through direct and/or indirect interactions with Company Personnel or individuals present (or previously present) on the Premises who may have COVID-19 or may have been exposed to COVID-19.  The Company assumes no liability for any COVID-19 related loss, damage or injury except as cannot be excluded by law.
  7. The Company accepts no liability to any Client or any other person in respect of any losses arising out of any event or events beyond the Company’s reasonable control or where the Company was unable to reasonably foresee and take commercially reasonable steps to prevent such loss or damage.

8. USE OF FACILITIES

  1. A Member is entitled to use the Studio’s facilities provided always that the Company may, via Company Personnel, at any time, and without prior notice, withdraw access to all or part of the facilities for any period or periods of time.  The Company may endeavour, where practicable, to provide notice, in connection with any cleaning, repair, alteration or maintenance work.
  2. Persons under the age of 16 may only attend Sessions as set out in clause 2.5.
  3. Members or Patients are not permitted to remove of any of the property under control of the Company from the Premises or to move such property from the Studio, Treatment Room or associated part of the Premises in which the relevant property is located.
  4. The removal of any of the property under control of the Company from the Premises may result in the termination of the Member’s membership or Patient’s treatment and legal action against the Member, Patient and/or their parent or guardian as appropriate.
  5. Subject to clause 8.6 Clients may use mobile telephones on the Premises but they should be on silent during any Session.
  6. No photos or videos and allowed to be taken on or of the Premises, Company Personnel or of other Clients of the Company without the prior consent of the relevant Client(s), Company Personnel and the Company.

9. PERSONAL BELONGINGS

Personal belongings are brought onto the Premises at the Client’s own risk and the Company does not accept liability for any loss or damage whatsoever.

10. DRESS

  1. Members are requested to wear comfortable clothing for Sessions.
  2. Members should attend yoga, barre and Pilates Sessions barefoot or, if preferred, with socks.
  3. Members clothing is required to be appropriate to the environment and such that it is not likely to cause distress or embarrassment to other Clients or Studio Personnel.

11. SAFETY AND HYGENIE

  1. No food, crockery or glassware is permitted in the Studios. Non-alcoholic drinks in a re-sealable (non-glass) container are permitted on the Premises.
  2. Other than guide dogs no pets are permitted on the Premises.
  3. If Members have a verruca, athlete’s foot or similar foot complaints socks must be worn.
  4. Clients must use the main entrance when entering or leaving the Premises. In the event of a fire, Members are asked to make their way to and out the front door unless it is unsafe to do so (in which case they should exist via the nearest available exit).
  5. Smoking is forbidden on the Premises.

12. GENERAL

  1. Clients are required to keep their contact details up to date in their online user profile. All communications will be assumed to have been received by the Client if the Company uses the Client’s details on file.
  2. The Company reserves the right to refuse admission to the Premises.
  3. A person who is not a party to the Registration Form has no rights to rely upon or enforce any term of the Registration Form under the Contracts (Rights of Third Parties) Act 1999.
  4. The company may, if a Client so wishes, communicate with the Client by electronic mail (“email”). By providing an email address to the Company the Client consents to receiving email communications from the Company related to the purpose for which the email address was provided, including notices pursuant the Terms and Conditions.  The Client also accepts to risk that email may not be a secure and confidential means of communication.  The Company will not be liable for any loss or damage suffered as a result of communicating with a Client by email.
  5. Clients must at all times observe the Studio or Treatment Room guidelines (as relevant) which may be notified to them from time to time and are requested to comply with any reasonable directions which Company Personnel may issue to ensure the smooth operation of the Premises for the convenience of all Clients and Company Personnel.
  6. Any marketing, educational or other materials of any nature whatsoever produced by the Company in connection with the Studios or Treatment Rooms and which are made available to Members at the Premises or on the website remain, at all times, the property of the Company and are subject to the Company’s copyright.

13. USE OF THE WEBSITE

  1. By using the Website, the User accepts these Terms and Conditions in full.
  2. No User may use the Website in any way to cause damage or take action to cause damage to the Website or impair of the performance, availability or accessibility of the Website.

14. INTELLECTUAL PROPERTY

  1. All content on the Website, including text, graphics, logos, videos, images, underlying code and software is the property of the Company or other relevant third parties. By continuing to use the Website the User acknowledges the material is protected by English law and International Intellectual Property law.
  2. No User is entitled to reproduce, copy or distribute in whole or any part the Website or materials therefrom unless given permission in writing from a director of the Company to do so.
  3. The Company accepts no liability to any User in respect of loss or corruption of any data, database or software.

Complaints Procedure

First things first – we will try and make sure you don’t have any cause to complain.  However, if you do have a complaint we want to resolve it as quickly as possible. Please call us or email us at hello@andosteo.co.uk (our contact details are at the bottom of every page) and we’ll do our best to resolve any issues you may have with our services, as soon as possible.

If the issue is something we can not resolve quickly we will keep you informed of the steps we are taking to resolve it.

If your complaint is not resolved to your satisfaction, and depending on the nature of your complaint, you can refer your complaint to the following outside bodies:

  • If your complaint relates to your consumer rights, you can contact Citizens Advice. They can also refer your complaint to local Trading Standards officers who may then investigate on your behalf.
